ROCHESTER, N.Y. (WROC) — Body worn camera video shows the moments leading up to Catherine Bonner’s arrest back in November at her home on Genesee Park Boulevard.

“I’ve never seen this and I made a point to say this in my motion papers. I can’t find case law that’s on point for this issue,” said Bonner’s defense attorney, David Pilato.

The video shows her ex-boyfriend, escorted by police, being encouraged to break in to Bonner’s house to retrieve his things.

Yet after screaming she feels unsafe and then pointing a gun out the window after her ex smashes through that window, she’s the one arrested.

She was charged with criminal possession of a weapon and menacing a police officer.

Her attorney is arguing that the behavior of the officers is what was unconstitutional. 

“I think for the most part, you show up to a situation where a boyfriend is trying to get things back from his girlfriend and you tell them to take it up in small claims court, or see if you can resolve it in some other way,” said Pilato.

After this incident, RPD sent out a bulletin to its officers, specifically ordering them to not encourage anyone to “break in” to a house, because there is no way to prove on scene that it is in fact their house.

Bonner is due back in court on June 4th.
