SAN JOSE (KRON)– A suspect in the fatal stabbing of a San Jose man last Saturday is not being charged being charged pending further investigation, the Santa Clara County District Attorney’s Office announced Thursday.

32-year-old Anthony Tafolla, 32, of San Jose, was arrested without incident and booked into the Santa Clara County Jail, according to San Jose police.

Tafolla was suspected of killing Eugene Davi, 39, of San Jose, police said.

“At this point, after a review of the currently available evidence, we have decided there’s insufficient evidence to charge Anthony Tafolla,” the district attorney’s office said in a statement.

According to police, Davi and another man were found suffering from at least one stab wound in the 3200 block of South White Road at about 12:45 a.m. Saturday.

Both victims were transported to a hospital where Davi was pronounced dead. The other man was treated for an injury not considered life-threatening, according to police.

Officers canvassed the area but were unable to find a suspect, police said. Homicide detectives continued to investigate the case and identified Tafolla as a suspect.

Tafolla’s name didn’t appear during a search of county jail records as of this afternoon.Bay City News contributed to this report.
