OAKLAND (KRON)– The second fugitive that escaped from a Palo Alto courthouse early November was captured by U.S. Marshals Sunday morning.
According to the Department of Justice, 47-year-old John Bivins was apprehended around 9:30 a.m. at a Fairmont Inn in the 16000 block of Foothill Blvd in San Leandro.

Tramel McClough, who Bivens escaped with on Nov. 6, was captured on Tuesday at a WalMart in Stockton, authorities said.
The search continued for Bivens who was last seen on Tuesday evening at a gas station, after fleeing from the Stockton Walmart. Bivens then attempted to run over a U.S. Marshal and California Highway Patrol Officer. He managed to escape after officers shot at him.
A thorough investigation led officers to the motel in San Leandro. Investigators saw Bivens walking out of the motel, ordered him to surrender, which he refused. The Department of Justice said he was forced into custody and will be transported back to Santa Clara once treated at a hospital.
KRON4’s Spencer Blake spoke with the owner of the motel, who told him a known accomplice of Bivin’s checked into a room about 4:15 p.m. on Saturday.
According to the owner, US Marshals arrived at Fairmont Inn around 7:30 p.m. asking about Bivins. Marshals spent a night in two other rooms, waited and watched for him to come out.
