SAN JOSE (KRON) — San Jose police have arrested an algebra teacher for allegedly sexually assaulting a 13-year-old female student, according to Sgt. Enrique Garcia.

Police said they found out about the assault on Jul. 23 when the victim told a friend about the assault. The friend then called San Jose police to report the crime, Garcia said.

During the investigation, police found that 64-year-old David Scott Graham was the victim’s algebra teacher at Harker Academy in 2007.

“Graham used his position of authority to exploit the victim into a sexual relationship. The victim was a 13-year-old student at the time,” Garcia said.

Police arrested Graham on Thursday and booked him into Santa Clara County Jail for two felonies: sexual assault of a minor under 14 years old and oral copulation.

Pam Dickinson, the director of Communications at the Harker School released a statement to KRON4.

“Today the San Jose Police Department brought to our attention allegations from a former Harker student, now graduated, of misconduct by Scott Graham while she was in middle school in 2007,” Dickinson wrote in a statement. “This is the first time that the school has been made aware of these allegations. We were shocked and deeply dismayed when the reported situation was brought to our attention today. Mr. Graham is in police custody, we immediately placed him on administrative leave, and the school is fully cooperating with the authorities in their ongoing investigation.”
