SAN FRANCISCO (KRON) — A San Francisco judge will hear Sheriff Ross Mirkarimi’s request to have his domestic violence-related conviction expunged from his record Monday morning.

Mirkarimi’s three-year probation for false imprisonment following a highly publicized incident where he grabbed his wife and bruised her arm in 2011 ended in March.

If the judge chooses to expunge Mirkarimi’s record, it wouldn’t be too uncommon. People convicted of misdemeanors routinely have their misdemeanor records expunged if they behave.

This request comes as the sheriff is in the middle of a re-election battle. The tough campaign may have affected his decision to see a clean record.

Despite requests for comment, neither Mirkarimi nor lawyer have responded to requests for comment.

The District Attorney for San Francisco said they would not oppose the request because he shouldn’t be treated differently than any other citizen.
