A repeat DUI offender is now facing felony murder and DUI charges after a fatal crash in Oakland early Sunday. 

According to CHP, the two-car crash happened on NB I-880 near Hegenberger Road and both cars were disabled in the third and fourth lanes of traffic.

Officials say the driver of one of the cars, a green Lexus, got out of his car and was standing in a lane of traffic when a white Lexus sedan driven by 56-year-old Maury Butler out of Berkeley crashed into him, throwing him into the second and third lanes of traffic. 

The man died at the scene of his injuries. 

CHP says Butler was driving the car while intoxicated and arrested for DUI. 

Officials say Butler was driving on a suspended driver’s license for prior DUIs and had three previous DUI convictions within the last 10 years. 

Butler was booked into Santa Rita Jail for the felony charges of murder and DUI, as well as a misdemeanor charge of driving on a suspended license.
