MONTEREY CO. (BCN) — A San Martin resident has been convicted of resisting, obstructing and delaying an officer, Monterey County District Attorney Dean D. Flippo announced Friday.
Diego Vasquez, 27, was convicted of the charges on Wednesday. The incident occurred on January 29 at 1 a.m. when officers were conducting a DUI investigation on North Main Street in Salinas.
Prosecutors said Vasquez, who was the passenger in a car, held out a cellphone and aimed it at officers during the investigation of the driver.
Vasquez then exited the vehicle and walked toward one of the officers as he pointed the cell phone at offices, prosecutors said. He refused to remain in the vehicle after being instructed to do so by officers.
Vasquez was arrested at the scene, and a loaded replica bb gun was later found in his waistband, prosecutors said.
He faces a maximum of one year in jail and a $1,000 fine when he is sentenced on May 20.
