A Kentucky lawmaker has pre-filed a bill that would allow employers to discriminate against smokers.
Sen. John Shickel (R-Union) is looking to remove protections against employment discrimination based on whether a worker is a smoker.
Right now KRS 344.040 currently lists smokers as protected from discrimination along with race, color, religion, national origin, sex, age 40 and over, or because the person has a disability.
State law currently allows for stop-smoking incentives and a difference in employee contributions for smokers.
