The family of a man shot dead by a BART police officer got the chance to meet face-to-face with the Alameda County District Attorney on Wednesday. 

They want to know whether she’ll bring any charges against the officer.

“She saw with her eyes that my son was shot in the back,” Tindle’s mother Yolanda Banks said.

“She did say I did see the video and acknowledged seeing that but gave no opinion about what that video represented,” Civil Rights Attorney John Burris said.

The video evidence was among the topics discussed during the first face-to-face meeting between Alameda County District Attorney Nancy O’ Malley and Tindle’s mother Yolanda Banks-Reed.

“She said that it is still under investigation and that she could not give any information as to when an arrest will be made or charged,” Banks-Reed said.

Burris has filed a wrongful death claim against BART.

He was also present at Wednesday’s meeting with the D.A. Burris says Officer Mateu’s initial statement is also very important in this deadly officer-involved shooting case

“That narrative said that Sahleem had did certain things,” Burris said. “Where did that come from? In our view, it had to come from the officer. So, we wanted to find out if the officer made this initial statement to the public relation’s officer at Oakland police about what he had seen and that’s the narrative that they used, that’s extraordinarily important because that narrative does not square with the video.”

“He puts his hands up, unarmed, unarmed, how many times have we heard this story?” Banks-Reed added.

The Tindle family and their attorney say no timetable was given on when the D.A. Will reach a decision on whether or not there will be any charges.

The spokesperson for D.A. O’ Malley told KRON4 that the only comment they have at this time Is that the case remains under investigation.
