CONCORD (BCN) — A man struck and killed by a civilian vehicle and police patrol car near the Concord Pavilion early Monday was identified Tuesday by the Contra Costa County coroner’s office as 29-year-old Robert Smith.

A man driving a civilian vehicle hit Smith, a Walnut Creek resident, on Kirker Pass Road near Kirkwood Drive in Concord at about 2:30 a.m.

Smith was hit a second time by a police patrol car driven by a Clayton police officer, according to Concord police.

It appears as if the first vehicle killed the victim, but the coroner’s office will help determine the exact cause and time of death, according to police.

Both the civilian driver and the Clayton officer are cooperating with the investigation and drugs or alcohol don’t appear to be a factor, police said.
