It is now up to the Sacramento District Attorney to decide if criminal charges are warranted in the police shooting of Stephon Clark.
The unarmed 22-year-old black man was shot and killed by officers while he was in his family’s backyard following a foot chase in March.
More than seven months after police fatally shot Stephon Clark, the District Attorney is now reviewing the evidence to determine if criminal charges will be filed against the officers involved.
The Sacramento D.A.’s office hopes to complete the review within 90 days but it could take longer depending on the circumstances.
In a statement Monday, officials said in part:
“The materials submitted by the Sacramento Police Department are voluminous and may take significant time to comprehensively examine.”
Prosecutors also noted they are not determining whether officers could have taken other actions the night of Clark’s death.
They say the review is strictly limited to an analysis of the action the officers actually took and whether the action is a crime prosecutable under law.
Stephon Clark died in his grandmother’s backyard after officers shot him multiple times mistaking his cellphone for a gun.
The death sparked several protests and shined a national spotlight on Sacramento.
The department has since changed policies related to body camera use and foot chases.
On Facebook Clark’s family released a statement saying the city needs to come together to put pressure on District Attorney Anne Marie Schubert to press full charges against the officers.
The family said, “we need to come together in solidarity in order to prevent this atrocity from happening ever again in our backyards.”
