There was a funeral on Monday for a man who died after being shot by police in Danville.

Now, his family has announced that they’re taking legal action against the police department.

White doves were released into the air following the funeral service for 33-year-old Laudemer Arboleda in Fremont.

“On the morning of Nov. 3, 2018, my uncle Laudermer Arboleda was shot and killed by Danville police,” Jessica Leong said.

On the day he was laid to rest, his family vowed that there would be no rest for them until they find out why he was killed during an officer-involved shooting.

His family says he was considering a move to Danville and was there that day looking for housing when police got a call about a suspicious person.

“We have not received any information from authorities about what actually happened on that day,” Leong said.

Civil right attorney John Burris is representing the family.

“We are here to make sure that they get their justice,” Burris said.

According to police, Arboleda led police on a pursuit through town, ultimately ending when an officer opened fire after investigators say he steered toward an officer.

“That is the officer’s negligence, his lack of due care, his lack of appreciation for a human life,” Burris said. “Now, whether that is because it was a brown person or a colored person or not? All I know is it was a colored person. He was driving a car, and he was shot by a white police officer under circumstances that were unjustified.”

Contra Costa County Sheriff David Livingston released this statement:

“This is a tragic case, yet once again John Burris is reaching for his well-worn race card. This is not about race. This is about a dangerous and reckless person trying to run down and murder a police officer. Once all investigations are completed, we look forward to sharing the full details with the public.”

Arboleda’s mother says although her son suffered from mental illness, he was not a violent person.

Burris says Arboleda had no criminal history.

“He was a good son, and I want justice for my son,” mother Jeannie Atienza said.
