SAN FRANCISCO (KRON) — 49ers linebacker Ahmad Brooks is now named as a cross-defendant in a civil lawsuit accusing him of sexual assault filed by the same woman who had accused former 49ers lineman Ray McDonald of sexual assault.

The lawsuit was filed Tuesday by attorney Gloria Allred on behalf of the unnamed woman. The suit claims that Brooks is being accused of sexually assaulting a passed out woman at a then-teammate’s home. McDonald, who had the charges against him dropped due to a lack of evidence, is now playing for the Chicago Bears.

Allred’s office distributed a written statement to the media but declined to issue further comment.

“Although our client who is 22 years old and resides in California is here with us today, she will not be making any statements or doing any interviews because her case is now in litigation,” the statement said.

McDonald had sued the woman for defamation after the San Jose Police Department investigated the allegations. The woman is now firing back in the defamation lawsuit claiming she believes there is surveillance video from the night in question which allegedly shows part of the sexual assault.

Citing documents, TMZ Sports says that the woman was at McDonald’s home on December 14, 2014, when she slipped and fell on the deck around his swimming pool, knocking herself unconscious for more than 8 minutes.

The woman claims the video will show McDonald’s friend Brooks “groped her person in a sexual manner” while she was blacked out. She claims McDonald then carried her up to his bedroom where he had sex with her without her consent.
