HAYWARD (BCN) — A Hayward man was arraigned Wednesday on a murder charge for the fatal shooting of 14-year-old Davon Ellis in Oakland on Feb. 28.
Donald Higgins, 28, is scheduled to return to Alameda County Superior Court in Hayward on June 11 to finalize his legal representation and possibly enter a plea.
Higgins, who has prior convictions for shooting at an occupied motor vehicle and second-degree robbery, was charged with murder last week for allegedly shooting Ellis, an honor student and football player at Oakland Technical High School, in the 3300 block of Brookdale Avenue in Oakland at about 7:50 p.m. on Feb. 28 as he and two friends were walking to a store.
Higgins was also charged with two counts of attempted murder for allegedly shooting at the friends with whom Ellis was walking.
Higgins previously was charged with two counts of the attempted murder of a peace officer and five counts of attempted murder and other charges for allegedly shooting at two Hayward police officers and a car with five occupants in incidents in Hayward several hours after Ellis was shot. No one was injured in those alleged shootings.
