SAN FRANCISCO (KRON) — No verdict on Day 5 of jury deliberations in the Kate Steinle murder case.

There was also very little movement in and out of the courtroom on Wednesday.

The prosecutor was spotted briefly but no sign of the defense, which indicates the six men and six women on the jury were busy trying to reach a decision.

It was all quiet outside Courtroom 13 at the San Francisco Hall of Justice where the jury ended Day 5 of deliberations without reaching a verdict in the Steinle murder case.

“You know, they are probably sifting through all of the evidence,” Criminal Defense Attorney Brian Ford said.

Ford has been keeping an eye on the trial. The defendant, 53-year-old Jose Zarate-Garcia, an illegal immigrant from Mexico, is being charged with murder for the 2015 shooting death of the 35-year-old Steinle while she was walking on a pier along the Embarcadero in San Francisco with her dad.

The defense is Garcia, a convicted felon, found the gun under a bench covered with a cloth that accidentally fired when he picked it up.

The prosecution’s case is built on the shooting being a deliberate act.

“The big issue, in this case, is whether or not the bullet was fired intentionally, whether or not it was actually aimed at a human being, probably would be the big issue there,” Ford said.

Another factor for the jury to consider is the semi-automatic pistol used to kill Steinle belonged to a federal law enforcement officer.

The gun was stolen from the officer’s vehicle and later placed under a bench on that pier.

“I know the defense put on some pretty interesting evidence in terms of how the gun was found wrapped in a rag,” Ford said. “They had some video of that. The prosecution had some circumstantial evidence as to what certain witnesses may have seen in close proximity to the shooting at the time. The jurors are probably just shifting through what all that means in terms of intent and that can be a tricky question because you’re trying to get inside a human being’s head after the fact and determine beyond a reasonable doubt what they intended to do.”

The question remains what is the jury going to do?

What we know is no verdict was reached on Day 5 of deliberations.
